Penny & Salt
These Terms & Conditions of Sale apply when you use pennyandsalt.com and when you buy goods from Penny & Salt through the website. They are intended for consumers purchasing for personal use and for delivery to UK addresses.
Please read these Terms before placing an order. They explain who we are, how orders are accepted, delivery and cancellation arrangements, and your legal rights. Nothing in these Terms limits or excludes any rights you have under UK consumer law.
1. About Penny & Salt
Penny & Salt is operated by Hannah Penny, trading as Penny & Salt ("Penny & Salt", "we", "us" or "our").
We currently accept orders through pennyandsalt.com for delivery to addresses within the United Kingdom only.
Our contact details are set out in section 15.
2. These Terms
These Terms form part of the contract between you and Penny & Salt when we accept an order from you. Our Privacy Notice and our Returns, Refunds & Cancellations Policy should also be read alongside these Terms.
If there is any conflict between these Terms and information given to you specifically about an order before the contract is made, the specific information given for that order will take priority.
3. Our products
We take reasonable care to describe and photograph our products accurately. However, colours may appear slightly different depending on the screen or device you use.
Many Penny & Salt pieces are handmade and may incorporate natural, hand-finished or individually made elements. Small variations in colour, texture, dimensions, finish or appearance may therefore occur between pieces. These variations are part of the character of handmade products and do not affect your statutory rights.
Product dimensions, materials, finishes, sizes and other important characteristics will be described on the relevant product page. Please check these details carefully before ordering.
Where an item is personalised, made to your specification or dependent on measurements or information supplied by you, you are responsible for checking that the information you provide is accurate. This does not affect your rights where we fail to make the item in accordance with the information you supplied.
4. Placing an order and forming the contract
When you place an order, you are offering to buy the goods shown in your basket on these Terms.
After you place an order, you will receive an electronic acknowledgement. An automated acknowledgement confirms that we have received your order; it does not by itself mean that we have accepted it unless the message expressly states that your order has been accepted.
A contract is formed when we send you confirmation that we have accepted your order. We may take or authorise payment before acceptance. If we cannot accept your order after payment has been taken, we will refund the amount paid.
We may decline an order where, for example, an item is unavailable, payment cannot be authorised, we identify an obvious pricing or description error, we reasonably suspect fraud or misuse, or the delivery address is outside an area we serve.
Please check your order carefully before submitting it. If you notice an error after ordering, contact us as soon as possible at contact@pennyandsalt.com. Your statutory cancellation rights are explained below.
5. Prices and payment
Prices are shown in pounds sterling (GBP). Product prices include any taxes that Penny & Salt is required to charge.
Any applicable delivery charge or other mandatory charge will be shown clearly as part of the total price at the point required by law and, in all cases, before you place your order. Optional delivery upgrades or other optional extras will be shown separately.
We may change prices at any time, but a price change will not affect an order that we have already accepted.
If we discover an obvious pricing error before accepting your order, we will contact you and give you the option to continue at the correct price or cancel the order. If we have already accepted an order where the pricing error was obvious and could reasonably have been recognised as an error, we may cancel the order and refund any amount you have paid.
Payment must be made using a payment method offered at checkout. Payment processing may be carried out by Shopify and/or third-party payment providers.
6. Delivery
Delivery options, charges and any estimated delivery or dispatch times will be shown on the website or during checkout before you place your order. Made-to-order or personalised pieces may have longer lead times, which will be stated or agreed with you.
Unless we have agreed a different delivery period with you, we will deliver the goods without undue delay and no later than 30 days after the contract is made.
Delivery dates and times described as estimates are not guarantees. If an event outside our reasonable control causes a delay, we will contact you as soon as reasonably possible and take reasonable steps to minimise the effect of the delay. This does not affect any statutory right you may have to cancel because of late delivery.
The goods remain at our risk until they come into your physical possession, or the physical possession of a person you have identified to receive them. If you independently arrange a carrier that we did not offer, risk may pass to you when the goods are handed to that carrier, as provided by law.
Please contact us promptly if an order does not arrive or appears to have been lost or damaged in transit.
7. Your right to cancel an online order
For most non-personalised goods bought online, you have a statutory right to change your mind and cancel the contract without giving a reason.
The cancellation period normally ends 14 days after the day on which you, or a person you nominate, receives the goods. If a single order is delivered in separate instalments on different days, the period normally runs from receipt of the last instalment.
To cancel, you must tell us clearly that you have decided to cancel before the cancellation period expires. You can do this by emailing contact@pennyandsalt.com or by using the model cancellation form at the end of these Terms. You do not have to use the form.
After telling us that you are cancelling, you must send the goods back within 14 days. Unless the goods are faulty, damaged, not as described, or we have agreed otherwise, you are responsible for the direct cost of returning them.
We will refund the price paid and, where required by law, the cost of the least expensive standard delivery option we offered. If you selected a more expensive delivery method, we do not have to refund the additional amount attributable to that upgrade.
We may make a deduction from the refund for any reduction in value caused by handling the goods beyond what is reasonably necessary to establish their nature, characteristics and functioning.
Where permitted by law, we may withhold the refund until we receive the goods back or you provide evidence that you have sent them back, whichever occurs first. We will make the refund without undue delay and within the statutory time limits.

8. Personalised and bespoke products
The statutory change-of-mind cancellation right does not normally apply to goods that are made to your specifications or are clearly personalised.
We will make it clear before you place an order where we consider a product to be personalised or made to your specification for this purpose.
This exception does not affect your statutory rights if a personalised or bespoke item is faulty, not as described, not fit for purpose, or has not been made in accordance with the specification agreed with you.
If you want to change or cancel a personalised or bespoke order before work has started, please contact us as soon as possible. We may agree to a change or cancellation where reasonably possible, but we are not required to do so where the statutory cancellation right does not apply.
9. Faulty, damaged or misdescribed goods
The goods we supply must meet the standards required by UK consumer law, including being of satisfactory quality, fit for any purpose made known to us where the law requires this, and as described.
If you believe an item is faulty, damaged, misdescribed or otherwise does not conform to the contract, please contact us at contact@pennyandsalt.com. Depending on the circumstances, you may have statutory rights to reject the goods, obtain a repair or replacement, receive a price reduction or receive a refund.
Nothing in these Terms or in our Returns, Refunds & Cancellations Policy limits your statutory rights.
10. The website, Shopify and intellectual property
Our online store is powered by Shopify. However, the contract for any purchase from the Penny & Salt store is between you and Hannah Penny trading as Penny & Salt, not Shopify.
All text, product photography, graphics, logos, designs and other original content on the Penny & Salt website are owned by or licensed to Penny & Salt unless otherwise stated. They are protected by applicable intellectual property laws.
You may use the website for your personal, non-commercial use. You must not copy, reproduce, modify, distribute, commercially exploit, scrape or systematically extract website content without our permission, except where the law permits it.
The website may sometimes contain links to third-party websites. We are not responsible for the content, availability or practices of websites we do not control.
We do not guarantee that the website will always be available, uninterrupted or free from technical errors. We may suspend or change website functionality where reasonably necessary, but this will not affect contracts already made with you.
11. Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, when the contract was made, both you and we knew it might happen.
We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and liability that cannot lawfully be excluded under consumer protection legislation.
If you purchase goods as a consumer, we are not responsible for business losses such as loss of profit, revenue, business opportunity or business interruption.
We are not responsible for damage caused by misuse of a product, failure to follow reasonable care instructions, or normal wear and tear, except to the extent that the law provides otherwise.
12. Privacy
We use personal information in accordance with our Privacy Notice. Please read that notice for information about what we collect, why we use it, who we share it with, how long we keep it and your data protection rights.
13. Complaints
If you are unhappy with a product or our service, please contact us at contact@pennyandsalt.com and we will try to resolve the issue promptly and fairly.
If a consumer complaint cannot be resolved directly, we will provide any information about alternative dispute resolution that we are legally required to provide at that stage.
14. Changes to these Terms and governing law
We may update these Terms from time to time. The Terms that apply to your purchase are the version in force when we accept your order. Changes made later will not retrospectively alter an existing contract unless the law requires otherwise or you agree to the change.
These Terms and contracts made under them are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you retain any mandatory consumer protections available to you under the law applicable where you live.
You may bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts available to you under applicable law.
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
